Application procedure

Qualification

1)  Macao residents and non-profit legal persons with residence in Macao SAR can apply for legal aid if they have insufficient financial capacity.
2)  The following persons staying in Macao SAR can also apply for legal aid if they have insufficient capacity:
i)  Non-resident workers with identity permits;
ii)  Holders of refugee status with recognition by competent authority of the Macao SAR;
iii)  Those with special permits to stay in Macao SAR under Article 8 of Law No. 4/2003, such as foreign students studying at institutions of higher education.
3)  The persons entitled to legal aid in accordance with other laws.

* In accordance with the provisions of Law No. 13/2012 “Legal Aid System”, if the total amount of available assets of the applicant and family members does not exceed the legal limit, the financial capacity will be considered as insufficient. Pursuant to the administrative regulation No. 2/2013, the legal limit of the amount of available assets of the applicant and family members is MOP 320,000. (Preliminary calculation of the available assets can be done by the analog calculator)

Application Procedure

Applicant may apply for legal aid by filling in the application form provided by the Legal Aid Commission



Documents required for application

Natural Person

1)  Copy of identification documents of the applicant and family members*;
2)  Copy of the income certificate(s) in the year preceding the date of filing the legal aid application (e.g.: payslip, salary statement issued by the employer, occupational tax notice, etc.) of the respective individual(s) referred to the above.
3)  Copy of the bank account(s) and electronic wallet(s) information in the year preceding the date of filing the legal aid application of the respective individual(s) referred to the above.
4)  Copy of assets (and related value) information owned by the respective individual(s) referred to the above [e.g.: properties, vehicle(s), insurance(s), securities etc.] *;
5)  Declaration of agreement (signed by respective individual(s) referred to the above) to investigate the bank account(s) and information on available assets**; and
6)  Document or information to support the litigation claim or compulsory arbitration claim;
7)  Proof of Address.

Legal Person

1)  Copy of identification document of the applicant’s legal representative*;
2)  Certificate of legal person registration issued by the Identification Services Bureau;
3)  Copy of articles of association published in the Macao SAR Gazette;
4)  Copy of the bank account(s) information of the year preceding the date of filing the legal aid application.
5)  Copy of assets (and related value) information* [e.g.: properties, vehicle(s), insurance(s), securities etc.]*;
6)  Declaration of agreement to investigate the bank account(s) and information on available assets**; and
7)  Document or information to support the litigation claim or compulsory arbitration claim;
8)  Proof of Address.

* Please bring the original documents for verification upon the submission of application.
** Application will be rejected if the applicant and family member(s) do not provide the declaration of agreement to investigate the bank account(s) and information on available assets.

Approval Time

A decision will be made within 15 days upon the receipt of the application as well as all documents and information. (If there is ample justification, the period may be extended up to a maximum of 15 days)
